These Terms & Conditions govern your use of services provided by Familock, located at 88 Rama IV Road, Khlong Toei, Bangkok 10110, Thailand. By accessing our services you agree to these terms in full. If you do not accept any part of these terms, please do not use our services.
1. Definitions
Throughout this document the following terms carry the meanings set out below:
- "Service" refers to all information, materials, and organisational assistance offered by Familock, including but not limited to the Family Records Index, Planning Education Pack, and Association Family Education programme.
- "User" / "You" refers to any individual or organisation that accesses or purchases a Service.
- "We / Us / Our" refers to Familock and its authorised representatives.
- "Content" refers to all written materials, reference lists, booklets, and educational packs provided as part of a Service.
- "Agreement" refers to these Terms & Conditions together with our Privacy Policy and Cookie Policy, as updated from time to time.
2. Acceptance of Terms
By contacting us, purchasing a Service, or receiving materials from Familock you confirm that:
- You are at least 18 years of age and have the legal capacity to enter a binding agreement under the laws of Thailand.
- Where you are acting on behalf of a business or community association, you have the authority to bind that organisation.
- You have read, understood, and agreed to this Agreement.
3. Service Description
Familock provides household information and organisational services to families and community associations in Thailand. Our three core services are:
- Family Records Index (฿3,600): Cataloguing, labelling, and indexing of household documents. A take-home reference list is provided. This service is purely organisational; no advice is given.
- Planning Education Pack (฿7,600): Plain-language educational booklets, a glossary, and a self-paced reading plan covering family-planning concepts and signposting to official guidance. Information only; no decisions are made on your behalf.
- Association Family Education (฿29,000): Programme materials, facilitator notes, and a delivery plan enabling community associations to share general family-planning information with their members. Strictly informational, with official sources signposted.
Services are available to residents and organisations throughout Thailand and are delivered in Bangkok unless otherwise agreed.
4. User Responsibilities
As a user of our Services you agree to:
- Provide accurate and complete information when requesting a Service.
- Use all materials and content solely for their stated educational and organisational purposes.
- Not reproduce, resell, or redistribute any Content without our prior written consent.
- Not use our Services for any unlawful purpose or in a way that infringes the rights of others.
- Keep any reference lists or organisational outputs confidential and secure.
- Contact us promptly if errors or inaccuracies are found in materials supplied.
5. Intellectual Property
All materials, formats, templates, booklets, and reference documents created by Familock remain our exclusive property. You are granted a limited, non-exclusive, non-transferable licence to use the materials for their intended purpose within your household or, for B2B clients, within your member community.
You may not adapt, translate, publish, or otherwise exploit our materials commercially without express written consent. Official third-party sources referenced within our materials remain the property of their respective owners.
6. Payment Terms
- All prices are displayed in Thai Baht (฿) and are inclusive of applicable VAT where required by Thai law.
- Payment is due before delivery of any materials or commencement of the Service unless a separate written arrangement has been made.
- Accepted payment methods will be communicated at the time of booking.
- Refunds may be considered at our discretion if a Service has not yet commenced. Once materials have been delivered or an appointment has been completed, fees are non-refundable unless there is a demonstrable error on our part.
- For the Association Family Education programme, staged invoicing may be arranged by written agreement.
7. Service-Specific Terms
Family Records Index: The scope of cataloguing is limited to documents you make available. We do not retain copies of your documents. The reference list is for your household use only.
Planning Education Pack: The pack covers general educational content and signposting to official sources. It does not constitute advice of any professional or regulated nature. The reading schedule is self-paced and carries no completion obligation.
Association Family Education: Facilitator notes and delivery plans are licensed for use within the purchasing association only. Re-licensing to third parties is prohibited. We reserve the right to update materials periodically; updated versions will be made available at no additional charge during the first 12 months.
8. Disclaimers
Our Services are provided on an "as is" basis for informational and organisational purposes only. In particular:
- Nothing in our materials constitutes professional, legal, financial, or any other regulated advice.
- We make no representation that materials are current or complete beyond their stated date.
- Outcomes from using our educational materials depend entirely on your own decisions and circumstances.
- We are not responsible for the content of external official sources to which our materials point.
9. Limitation of Liability
To the fullest extent permitted by Thai law:
- Our total liability arising from any Service shall not exceed the amount paid by you for that Service.
- We shall not be liable for indirect, incidental, or consequential loss, including loss of data, loss of income, or loss of opportunity.
- We shall not be liable for events outside our reasonable control, including natural disasters, government actions, or communications failures.
10. Indemnification
You agree to indemnify and hold Familock and its staff harmless from any claim, loss, or expense arising from your misuse of our materials, your breach of this Agreement, or any actions taken by you in reliance on the information provided, beyond the intended educational and organisational purpose.
11. Termination
Either party may bring a service arrangement to a close by written notice. Where a Service has not commenced, any prepayment will be refunded minus reasonable administrative costs. Where a Service is in progress:
- Work completed to the point of termination will be invoiced at a pro-rata rate.
- All materials already delivered remain subject to the licence terms in Section 5.
- Provisions relating to intellectual property, disclaimers, and limitation of liability survive termination.
12. Dispute Resolution
This Agreement is governed by the laws of the Kingdom of Thailand. In the event of a dispute:
- We encourage an initial informal discussion by email to [email protected] within 30 days of the issue arising.
- If informal resolution fails, both parties agree to attempt mediation before pursuing litigation.
- Any unresolved claims shall be submitted to the jurisdiction of the courts of Bangkok, Thailand.
13. General Provisions
- Entire Agreement: This Agreement together with our Privacy Policy and Cookie Policy constitutes the full understanding between us.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full effect.
- No Waiver: Failure to enforce any right on one occasion does not constitute a waiver of that right.
- Assignment: You may not transfer your rights under this Agreement without our written consent. We may transfer our obligations to a successor organisation with reasonable notice.
- Notices: Formal notices should be sent by email to [email protected] or by post to our Bangkok address.
14. Changes to Terms
We may update these Terms & Conditions from time to time to reflect changes in our services or applicable law. The updated version will be posted on our website with a revised "Last Updated" date. Continued use of our Services after that date constitutes your acceptance of the revised terms. We recommend reviewing this page periodically.
